Appellant, Strasburg Scooters, LLC ("Scooters"), appeals from an order sustaining the preliminary objections of Strasburg Rail Road ("Rail Road") and dismissing *1066 Scooters' complaint with prejudice for lack of subject matter jurisdiction. Scooters alleged that the manner in which Rail Road uses its side tracks interferes with Scooters' use of real property ("the Property") that Scooters leases from MarNik Holdings ("MarNik").
