In June, 1932, Clint Taylor was convicted in the Powell circuit court of the offense of housebreaking, and was sentenced to serve five years in the state penitentiary. He appealed and to secure his release from imprisonment pending the appeal executed bond in the-penal sum of $5,000, pursuant to section 75 of the Criminal Code of Practice. The judgment of conviction was affirmed by this court on February 24, 1933. A petition for a rehearing was filed and was overruled on April 14, 1933, on which date the mandate of this court issued.
