After the town of Westford (‘Town”) failed to make certain payments to retired Westford police officer Mary Ann McShea (“McShea”) related to health insurance premiums and medical expenses, McShea brought this action for breach of contract and violation of G.L.c. 41, §100B. After a jury-waived trial, a judge found in favor of McShea on the breach of contract claim, but ordered her to change her health insurance to mitigate her damages for health insurance premium differential payments.
