This matter is before the court on the Magistrate Judge’s report and recommendation (filing 175) that Defendant’s motion to vacate, set aside or correct his sentence pursuant to 28 U.S.C. § 2255 (filing 168) be granted in part and denied in part, and on the Government’s objections to the report and recommendation (filing 176), filed pursuant to 28 U.S.C. § 636(b)(1) and NELR 72.4.
