The plaintiff brought his action against the defendant to recover damages for injuries alleged to have been sustained by him as an employee of defendant, by reason of the negligent and unskilful conduct of the defendant’s agent in running a certain train of defendant, conveyed by a steam locomotive, upon which the plaintiff was being conveyed in the *514performance of his duty as such employee, and without fault on his part.
