ROBERTS, J., for the Court:

¶ 1. On March 31, 2009, Derrick Anthony Arnold was indicted, as a habitual offender pursuant to Mississippi Code Annotated section 99-19-81 (Supp.2011), on two counts of the sale of marijuana in violation of Mississippi Code Annotated section 41-29 — 139(a)(1) (Supp.2011). At trial on October 5, 2009, in the Scott County Circuit Court, Arnold was absent. Trial resumed the following day, and Arnold was still absent. A jury convicted Arnold on Count I of his indictment, and he was sentenced to serve six years in the custody of the Mississippi Department of Corrections…
