The defendant, L. P. Hammonds, was charged in the county court of McIntosh county, on September 29, 1939, by information with the offense of unlawful transportation of intoxicating liquors, was tried, convicted, and sentenced to serve 30 days: in the county jail and to pay a fine of |50, and he appeals to this court.
The only contention made by counsel for defendant in his brief is that the evidence is inadmissible because it was obtained by an illegal search of defendant’s person.
The evidence offered by the state is that Carl Brady, a policeman at Eufaula, saw defendant going down the highway…
