OPINION
GERRY, Chief Judge:
Plaintiffs filed this action under the Education for All Handicapped Children Act (“EHA”), 20 U.S.C. §§ 1400 et seq., as amended by The Handicapped Children’s Protection Act (“HCPA”), 20 U.S.C. §§ 1415 et seq. (West 1990). In March of 1989, plaintiffs filed a petition with the New Jersey Department of Education seeking a hearing regarding the placement of their son, Daniel, in an appropriate special education program.
