Reversing.

In 1927 C. T. Swoope was the owner of certain lots situated in-the city of Covington, Kenton county, Ky., and desiring to have a building erected thereon, entered into a contract, for an agreed consideration, with Bertram Wagner to erect it according to agreed plans and specifications. The building was completed during the year 1927. Pending its construction Swoope paid to Wagner the agreed price, except $3,588.11.
