— The case presents a question largely of fact. Practically the only evidence is that of the defendant, who was called as a witness for the plaintiff. The plaintiff also offered a transcript of defendant’s evidence given in her divorce case. Defendant’s husband was not called, as a witness, and his whereabouts at the time of the trial of this case were unknown to appellee. Plaintiff also offered in evidence a brief excerpt from the transcript of the testimony of defendant’s husband in the divorce case.
