The bill avers that the complainant advanced to the defendant Brown fifty dollars, with which to purchase the premises in question for him, and that Brown undertook the trust. That, on the same day, Brown bargained with Swaringen for the land, paid him therefor the fifty dollars advanced by the complainant, and took a bond for a deed to himself, and that he promised to convey to the complainant so soon as he should get a deed from Swaringen.
