—Appellant was convicted of theft, and his punishment assessed at a fine of $50 and ten days confinement in the county jail.
Appellant asked the court to charge the jury, as follows: “You are instructed that before you can convict the defendant in this case you must first find that at the very time the defendant took said corn he took same without the consent of the owner; second, that he took same with the intent at the time to deprive the owner of the value of said corn; third, and that- the defendant had the intent at the time of the taking to permanently appropriate the same…
