This is a petition for special action from the denial of a motion for change of judge pursuant to Rule 10.2, Arizona Rules of Criminal Procedure (1973), 17 A.R.S.

The facts are not in dispute. On 15 November 1976, defendant and two others were charged by information with rape in the first degree, A.R.S. §§ 13-611, 614, 138, 139, 140, in Cause Number CR-95164.
