John ArcMe was the first husband of Addie Brown, the appellee, and three children were born of their marriage. They resided in Lawrence county, Ohio, and *593about 1912 John Archie abandoned his wife and children and soon thereafter he was indicted by the grand jury of Lawrence county, Ohio, for the offense of failing to provide for his wife and children, but was not arrested under the indictment until January, 1915, when he was taken into custody and confined in the jail of Lawrence county.
