The appellant, Jerry Modlin, sustained spinal injuries following an electric shock from a hand-held drill and a subsequent fall on the premises of the appellee, Swift Textiles, Inc. (Swift). The injury arose out of and was within the scope of the appellant’s employment with Bahnson Service Company (Bahnson), a subcontractor of PotterShackleford Construction, Inc. (Potter-Shackleford).
