This is an action for an injury to the plaintiff’s horse and wagon, claimed to have been caused by a defective highway.

*432The questions upon this appeal arise out of the facts found, and the substance of the finding may be stated as follows: — ■ On the 24th of July, 1894, and for some considerable time prior thereto, the Bridgeport Traction Company was and had been engaged in building a street railway along the center line of a highway in Stratford called Stratford Avenue.
