The appellee was plaintiff' in the court below and brought this suit against the state revenue agent, alleg*ing that appellant was the duly elected and qualified state revenue agent, and that the American Surety Company was surety on his official bond; that, during 1923, and prior thereto, Stokes Y. Robertson had been the duly elected, qualified, and acting state revenue agent in the state of Mississippi, and was the predecessor of appel lant; and that, during said time, said Stokes V.
