In the District Court the plaintiffs in this action claimed a permanent injunction and $5,000 damages. The court gave judgment for a permanent injunction and $1 damages. From this judgement the plaintiffs appealed to the Superior Court, and afterwards the defendants appealed to this court. The appeal to the Superior Court was perfected and allowed on the 20th of November, 1908, and the appeal to this court was perfected and allowed on the day following.
