These actions were brought to recover penalties for failure to pay, when due, percentages of the earnings of the respective defendant street railroad companies under the provisions of contracts made by said companies in accordance with the requirements of section 175 of the Railroad Law. The contracts provided that the respective railroad companies would pay certain percentages of their gross income for the privilege of constructing and operating certain sections of the railroads, according to the ratio of said sections to the entire road.
