Count one charges, and the answer admits, that the defendant was convicted of the crime of embezzlement in the municipal court of Rock county, and duly sentenced to pay a fine of $200 and costs, or be confined in the Rock county jail for sixty days. At the time of the hearing before the referee the defendant was serving this sentence.
