Brosman, Judge:

Uchihara, the petitioner, was con-vieted following trial by general court-martial at Yokohama, Japan, of the offense of desertion with intent to avoid hazardous duty, to wit, service in Korea, in violation of Article of War 58, Í0 USCA § 1530. Trial was held on *124June 5, 1951, and the accused was sentenced to dishonorable discharge, total forfeitures, and confinement at hard labor for seven years.
