Maxwell, Judge:

This proceeding in mandamus involves a Republican membership of the board of education of the Independent School District of Hinton.

The board consists of four members, of whom, under legislative inhibition in the act creating said independent district, not more than two shall be members of the same political party. Thus, there have been two Republicans and two Democrats on the board. This year, two members were to be elected, of opposite politics.
