This is an appeal on questions of law from a judgment of the Court of Common Pleas of Darke County, granting leave to the appellee claimant, Ralph White, tq present his claim for damages against the estate of Arthur Price, deceased.

On May 9, 1947, the claimant and decedent were involved in an automobile accident in which the claimant sustained serious injuries and decedent died as a result of his injuries.
