This was an action by M. R. Smith and Alfretta Smith against the defendants in error to recover for the conversion of certain personal property. There was a trial to a jury, which resulted in a verdict for the defendants. Plaint-*676jiffs filed a motion for a new trial, which was overruled by the court. The journal entry in the case reads as follows :

“Now, on this 30th day of March, 1891, this cause poming on for hearing upon the petition for a new trial, filed herein by the plaintiff, the court in consideration thereof, and being fully advised in the premises, does overrule the same, to which…
