ELLIS, Judge.

Plaintiff appeals from a judgment dismissing its suit on an exception of no cause of action.

In its original petition, filed on November 11, 1953, plaintiff alleges substantially the following facts, viz.:

Louis Calamia executed a promissory note, identified with a chattel mortgage, for $892.80 on April 8, 1953, payable in 18 monthly installments of $49.60 each; beginning on May 8, 1953. In Jiily of 1953, Calamia became delinquent in making the payments on the note and, on August 15, 1953, Marvin Renfro agreed to assume the balance of $595.15 due on the note and mortgage. Plaintiff…
