Motion by plaintiff for a new trial, and motion by defendants for a judgment notwithstanding the verdict and cross motion by plaintiff for attorney’s fees are consolidated for disposition.

This is an action for monetary damages for false arrest and imprisonment and violation of constitutional rights. On April 17, 2000, plaintiff, while driving his motor vehicle, a black Lexus, was stopped by Police Officer Papadopoulos and his partner, Police Officer Dominick Maranzano (sued herein as Police Officer John Doe).
