The prosecutor attacks the validity of a judgment entered against him, in a proceeding instituted by the petitioner in the court below, who is the respondent, here, under the Workmen’s Compensation act, to recover compensation for the death of her husband alleged to have been the result of an accident arising in the course of and out of his employment.

The court found that the death of petitioner’s decedent arose in the course of and out of the employment of the deceased.
