MEMORANDUM OPINION AND ORDER
BRIONES, District Judge.
On this day, the Court considered Jose Cedillo-Gonzalez’s (“Petitioner”) Motion to Alter or Amend Judgment Pursuant to Rule 59(e), filed on March 16, 1999, in the above-captioned cause. The Immigration and Naturalization Service (“INS”) filed its Opposition to Petitioner’s Motion on April 9, 1999. After due consideration, the Court is of the opinion that the Motion should be granted for the reasons that follow.
