Monroe, J.

The defendant was found guilty of murder and sen-' tenced to be hanged, and, a new trial having been refused, has appealed.

The only question reserved for the consideration of this court is presented in. a bill of exception, which reads as follows, to-wit:

“Be it remembered that, on the trial of this cause, the accused, “ through his counsel, moved a postponement of the trial for the pur“pose of obtaining certain witnesses, which were important for his “ defense, said motion being in writing and being made part of this “ bill of exception,…
