Plaintiff brought this action against the defendant for the sum of fifty thousand dollars.

On the 14th of July, 1895, at about 12 o’clock at night, plaintiff was a passenger on the inbound West End train of the defendant railroad company. The car was a summer car. At the corner of Canal and Tonti streets he was knocked off this car by an electric light pole of the defendant light company.
