Appeal from tbe City Court of Montgomery. Tried before Hon. J. D. Cunningham:. Tbe appellant was convicted on an indictment for an assault with intent to murder, under tbe following circumstances : Two policemen, Ed. Williams and another, of tbe city of Montgomery, under a verbal order from tbe marshal of tbe city, arrested tbe accused just outside of tbe corporate limits of tbe city, but within tbe county of Montgomery, and brought him within tbe city boundary.

An arrest may be made by any policeman any where within the limits of his county. — Revised Code, § 3683. It may be made by a policeman without a warrant, on any day and at any timé, for any public offense committed, or a breach of the peace threatened, in his presence; or when a felony has been committed, though not in his presence, by the person arrested; or where a felony has been committed, and he has reasonable cause to believe that the person arrested committed it; or when he has reasonable cause to believe that the person arrested *43has committed a felony, although it may afterwards…
