This matter is before the Court on petitioner Brotherhood’s motion to dismiss respondent railroad’s counterclaim for lack of jurisdiction over the subject matter and for lack of jurisdiction over the person. The substance of the principal litigation, as it was originally instituted, involves a petition filed pursuant to Section 3, First (p) of the Railway Labor Act (45 U.S.C. § 153, First (p) ), seeking the enforcement of an award and an order issued by the First Division of the National Railroad Adjustment Board in favor of the petitioners.
