Appeal from a judgment of the Supreme Court (Lamont, J.), rendered. April 12, 2007 in Albany County, upon a verdict convicting defendant of the crimes of rape in the third degree and endangering the welfare of a child.
Defendant, who was then 23 years old, allegedly had sexual intercourse with a 16 year old who was at his home to babysit his infant. He was charged in a four-count indictment, and eventually convicted by a jury of two of the charged counts, one count of rape in the third degree and one count of endangering the welfare of a child.
