SENTENCING MEMORANDUM

I.INTRODUCTION

The matter before the court is the sentencing of Defendant Mack Arthur Davis, Jr.

II.ISSUE

The court must determine whether Defendant is a “career offender” for purposes of USSG § 4B1.1 (2007). See United States v. Braggs, 511 F.3d 808, 812 (8th Cir.2008) (stating that a district court must first calculate the defendant’s advisory Sentencing Guidelines range) (citing Gall v.
