This appeal arises from a final order of the Circuit Court of Mercer County which affirmed a decision of an administrative law judge (hereinafter “ALJ”) of the West Virginia Educational Employees Grievance Board. The circuit court affirmed the ALJ’s decision that the Mercer County Board of Education (hereinafter the “Board”), appellee/respon-dent below was correct in denying Mr. Billy J.
