McGOHEY, District Judge.

On May 1, 1949, at approximately 5:21 P.M., the S.S. Marine Leader, a T-2 type tanker owned pro hac vice by the Standard Oil Company of New Jersey, while outward bound, in ballast, from New York was in collision in New York Harbor with the anchored and heavily laden 5.5. Jalaketu, Indian registry, owned by Scindia Steam Navigation Co., Ltd.

Scindia’s claim is that during a heavy fog The Jalaketu was anchored in an area appropriate for anchorage, seven-eighths of a mile due east of buoy 2A at the seaward entrance to Ambrose Channel and well north of the northern boundary…
