Young, J.:

The action was brought by the plaintiff beneficiary under an accident and health insurance policy issued by the defendant insuring one John Smith against accidental bodily injuries and providing certain weekly accident indemnity and for weekly illness indemnity. The policy was issued on the 23d day of June, 1919.
