TANG, Circuit Judge:
Joseph Smith, a California state prisoner, appeals the district court’s denial of his habeas corpus petition under 28 U.S.C. § 2254. He contends that he was denied effective assistance of counsel because his attorney was mentally incapacitated during the time of his criminal trial and that the state court had an obligation to conduct, sua sponte, an evidentiary hearing to determine the competency of his counsel. This appeal raises two novel questions but the petitioner’s contentions are ultimately un persuasive. The denial of the petition is affirmed.
