Legacy Community Health Services (“Legacy”)—a Federally Qualified Health Center (“FQHC”)—sued the Texas Health and Human Services Commission (the “Commission”), through its Executive Commissioner, alleging that Texas’s reimbursement scheme violated the Medicaid Act (1) by requiring Managed Care Organizations (“MCOs”). fully to reimburse FQHCs, (2) by failing to ensure that Texas itself would reimburse an FQHC if an MCO does not reimburse the FQHC in the first place, and (3) by withholding payments for certain non-emergency services that Legacy has been providing…
