This is an action of debt upon a judgment obtained by the plaintiffs against the defendant in the superior court of Middlesex County, Massachusetts, on May 1, 1933. The defendant’s plea alleged that the Massachusetts court was without jurisdiction to render the judgment, because, at the time of the issuance of the writ, he was not a resident of the Commonwealth of Massachusetts, was not personally served with the process, and did not appear and defend the suit.
