This appeal arises out of an action brought by plaintiff Hartford Accident and Indemnity Company for declaratory *221judgment that it is not required either to defend or to pay any award of damages that may be made in an action brought by defendant Lawrence Critelli under the Civil Rights Act (US Code, tit 42, § 1983) against defendants Stephens and Russo, police officer employees of defendant Village of Hempstead.
