MEMORANDUM BY THE COURT

This is the case of an Army officer who brings suit for relief under section 1062 of the Revised Statutes from responsibility for the loss of $1,382.55 of Government funds for which the officer was responsible and for which sum he has been charged in his official accounts by the accounting officers of the Government. The plaintiff is not now in the *414Army, and before resigning therefrom paid the above amount in full to the United States.

Under section 10G2, Revised Statutes, a disbursing officer is not entitled to relief unless the loss occurs “ without fault or negligence…
