This action stems from a probate proceeding which sought to determine whether the proceeds of a life insurance policy should become a part of the estate of the deceased, Leroy Seitz, or whether the proceeds should pass directly to his son, Aaron Seitz, the contingent beneficiary under the policy.

The probate court ruled that the decedent’s contingent beneficiary, Aaron Seitz, was entitled to the residual insurance proceeds. The petitioner appeals, claiming that the decision is contrary to general principles of contract law.
