This is an action to recover the balance due on a promissory note for the sum of $10,000 payable in five years signed by the defendant and dated November 3, 1875. The note was secured by a mortgage on real estate. On May 3, 1888, the defendant (maker of the note and then owner of the equity of redeeming the mortgage) made an agreement with the then holders of the note by which the rate of interest was reduced to five per cent per annum and the time for payment of the principal was extended to May 3, 1895.
