*954Appeal and cross appeal from an order of the Supreme Court, Erie County (John A. Michalek, J.), entered January 8, 2004. The order granted in part plaintiff’s motion for partial summary judgment and granted defendant’s cross motion for summary judgment dismissing the complaint in a personal injury action.
It is hereby ordered that said appeal insofar as it concerns the cross motion be and the same hereby is unanimously dismissed and the order is modified on the law by denying the motion in its entirety and as modified the order is affirmed without costs.
