This motion is made for an injunction enjoining the defendant from the use of the plaintiff’s corporate name, upon the following state of facts: The plaintiff is a well-known corporation, for more than 50 years located and carrying on a large business, mostly fiduciary, in'William street, in the city of Hew York, as a trust company. It has a splendid reputation for solvency, and is probably as well-known in this section, and throughout the country, as any institution in the city of Hew York.
