The appellant, Gary Leon Brown, appeals from the trial court's denial of his petition for post-conviction relief under Rule 20, A.R.Crim.P.Temp. (now Rule 32, A.R.Crim.P.). Brown was convicted of capital murder for the intentional killing of Jack McGraw during the course of a robbery. § 13A-5-40(a)(2), Code of Alabama 1975. The trial court sentenced Brown to death.
