Judgment, insofar as it imposes sentence, unanimously modified as a matter of discretion in the interest of justice and otherwise judgment affirmed, in accordance with the following memorandum: Defendant was convicted by a jury of attempted murder in the first degree (Penal Law, § 125.27, subd 1, par [a], cl [i]; subd 1, par [b]; § 110.00) as a result of an incident that occurred on November 1, 1979 when he shot a Rochester police officer in the back with a rifle.
