I. PROCEDURAL HISTORY

On December 4, 1985, a hearing was held before Judicial Hearing Officer Maurice Grey to determine whether certain physical evidence should be suppressed as the fruit of an illegal arrest. One witness was called at the hearing: arresting Officer Carmen Chiclana. Officer Chiclana’s testimony was found to be credible, sub silentio, by the Judicial Hearing Officer.
