The defendant was charged in four indictments with assault with intent to kill (G. L. c. 265, § 29), two acts of assault and battery by means of a dangerous weapon to wit: an automobile (G. L. c. 265, § 15A), and possession of heroin (G. L. c. 94C, § 34). A jury convicted the defendant on all indictments except the indictment charging assault with intent to kill. On that charge, the juiy convicted the defendant of simple assault, and the conviction was placed on file. See note 2, infra.
